As awareness of plastic pollution continues to grow, governments worldwide are implementing measures to reduce the environmental impact of this material. In line with this trend, the Tax on Non-Reusable Plastic Packaging is introducing significant changes that will affect manufacturers, importers, and consumers starting January 1, 2024.
Recycling Certification: A New Requirement
As of the mentioned date, the amount of recycled plastic in packaging subject to this tax must be certified by an accredited entity. This certification will be carried out according to the UNE-EN 15343:2008 standard and will be mandatory to demonstrate compliance with legal requirements regarding plastic recycling.
Scenarios and Certification Entities
There are different scenarios for issuing certifications, depending on the location of the packaging manufacturer:
- Packaging manufactured in Spanish territory: Certification entities must be accredited by the National Accreditation Entity (ENAC).
- Packaging manufactured in another EU Member State: Certification entities must be accredited by the national accreditation body designated in accordance with Regulation (EC) No 765/2008.
- Products manufactured outside the European Union: Certification entities must have recognition from ENAC or an accreditor with whom ENAC has an international recognition agreement.
It is crucial to pay special attention to operators working with countries like China and intending to certify the production of their packaging with recycled plastic. It is recommended to ensure that the certifying company has an agreement with ENAC to avoid possible complications.
Transition and Final Considerations
Until now, the amount of recycled plastic could be certified through a responsible declaration signed by the packaging manufacturer. However, with the implementation of this new regulation, obtaining certification from an accredited entity, such as AENOR, among others, will be necessary. Therefore, it is essential to address this issue in advance and not leave it to the last moment.
To date, no moratorium has been announced for these certifications, so it is important to stay informed about any developments that may arise regarding this matter.
